Terms & Conditions

SERVICE PROVIDER: Kelly Burns-Muir of UNICORN CLEAN

Services Provided

The Client will engage the Service Provider to provide the cleaning services as described in their registered cleaning package.

 

  1. The Service Provider shall provide the services to the Client in consideration for the Client paying the fee to the Service Provider, subject to the provision of this agreement.

  2. The Service Provider shall start providing the services on the commencement date.

  3. The services shall be performed by such employees or agents that the Service Provider may choose as most appropriate to carry out the services.

 

Location

 

The Service Provider shall provide the Services in such places and locations as set out with client.

Fees and Payments

 

The fee for the services provided under this agreement are as follows:

 

  1. The Service Provider shall be entitled to invoice the Client monthly.

  2. The payment of the fees shall be made by the Client to the Service Provider within the following period of receipt of invoice:

 

Due by the last working day of the month, paid directly by bank transfer to the Service Provider (payment details can be found on your invoices). Payments must be cleared prior to the following months cleans being due.

 

  1.  If the Client does not make payment by the date stated in an invoice or as otherwise provided for in the agreement, the service provider shall be entitled to:

 

  1. Charge a late payment fee on the outstanding amount at the rate of 10% of the net value of the invoice.

  2. Require the Client to pay, in advance, for any services (or any part of the services) which have not yet been performed.

  3. Not perform any further services (or any part of the services).

 

  1. The Service Provider reserves the right to re-evaluate its charges at any time for business related reasons.

 

Client’s Obligations

 

During the performance of the services, the Client undertakes to:

 

  1. Pay the fees and any other costs herein stipulated at the times and in the manner aforesaid and without any retention, deduction or set-off save as so permitted under this agreement.

  2. Co-operate with the Service Provider as the Service Provider reasonably requires.

  3. Provide the information and documentation that the Service Provider reasonably requires.

  4. Ensure that the Client’s staff and agents co-operate with and assist the Service Provider; and

  5. Make available to the Service Provider such facilities as the Service Provider reasonably requires.

 

 Access to Property

 

● The Client agrees to give to the Service Provider a key and/or details of any access/alarm codes. If an alarm code is not provided, then the alarm must be turned off on the days that cleaning services are to be provided.

● Details of keys and access/alarm codes will be kept strictly confidential, and the Service Provider will take all reasonable steps to ensure the security of physical keys and access codes.

● If the Service Provider is prevented from gaining access to the Clients premises, the time lost to the Service Provider shall be considered at 50% of the cost of the service and the Service Provider reserves the right to invoice the Client accordingly.

 

Breakage/Damage

 

The Service Provider warrants that it will use reasonable care and skill in performing the services.

 

● If the Client has any concerns, he/she must raise them within 24 hours of the cleaning service being provided.

● The Service Provider is not liable for any loss, damage, or injury due to the breaking or disintegration of any cracked, defective, or broken parts of the property during the cleaning service. The Service Provider is not liable for any loss, damage, or injury due to general wear and tear resulting from the cleaning services provided. The Client must secure and/or move any items of either extreme monetary or sentimental value.

 

Cancellation and Changes

 

  • Failure to provide a minimum of 24 hours’ notice to cancel an appointment will incur a charge equal to 50% of the missed cleaning service. A 14-day notice period is required to postpone an appointment due to pre booked holidays/school holidays etc where possible.

  • Deep Cleans are charged at a rate of 50% of the fee in advance and the remaining 50% payable on receipt of invoice, upon completion of the service.

 

Confidentiality and Data Processing

 

● The Client agrees that the Service Provider may keep and process any personal data required for the purposes of providing the cleaning services required. The Service Provider agrees to ensure all personal data is kept strictly confidential.

 

Data Protection

 

Where the provision of the services requires the sharing or processing of personal data the parties shall at all times comply with any and all relevant data protection laws and regulations which are currently in force or which may from time to time be enforced including but not limited to the Data Protection Act 2018 and the General Data Protection Regulation (GDPR) and any other act of parliament, regulation, order, statute,

 

subordinate legislation, mandatory guidance or code of practice, judgement of a relevant court of law, or directives or requirements of any regulatory body which relates to the processing and storing of any and all personal data of individuals and shall ensure that such personal information is held securely and only lawfully disclosed.

 

Variation

 

●The Service Provider reserves the right to amend these terms for any reason and will provide the Client with no less than 14 days advance notice of any changes to these terms.

 

Termination

 

Without prejudice to the other remedies or rights a party may have, this agreement may be terminated:

 

  1. Forthwith by either party if the other commits any material breach of any term of these conditions and which (in the case of a breach capable of being remedied) shall not have been remedied within twenty on (21) days of written request to remedy the same.

  2. At any time by either party upon service of 28 days’ notice in writing to the other.

  3. Forthwith by the Service Provider if the Client fails to make payment of any sums due, by the due date.

  4. Forthwith by either party if the other shall become unable to pay its debts or otherwise suffer insolvency events.

  5. Forthwith by the Service Provider upon notice to the Client in the event that the Client or its employees or agents shall engage in any conduct prejudicial to the business of the Service Provider or in the event that the Service Provider considers that a conflict or potential conflict of interest has arisen between the parties.

 

Direct marketing: We may use your personal information to contact you by post, phone, or e-mail with information about our services. We may also use photos of our work at your premises for marketing purposes. Any confidential or personal information will never be included in the marketing.
